Software License & Disclaimer

Why this page exists: NTPSense is network security software. If it's misconfigured, if an upstream open-source component has an undiscovered vulnerability, or if an attacker is simply more capable than any given deployment, a breach can still happen. This page defines — in plain terms — that operating a network is your responsibility, and limits what NTPRO TEKNOLOGI JAYA, its directors, and employees can be held liable for. Read it before you deploy.

0. NTPSense CE vs. NTPSense Pro — two different licenses

NTPSense Community Edition (CE) is free, open-source software licensed under the Apache License 2.0. Its full source code — the Rust control daemon, the web UI, the installer, and the console tooling — is published at https://github.com/ntpsense/ntpsense-ce, including the complete LICENSE file. You may use, modify, and redistribute CE under Apache 2.0's terms — including commercially — without needing permission from us. Sections 1–6 and 9 below (the commercial EULA terms: license grant, no-resale, liability caps, indemnification, termination) do not apply to CE — Apache 2.0 alone governs CE. Sections 2, 3, 4, 7, and 8 (no warranty, security disclaimer, your responsibility as operator, third-party components, export restrictions) describe real operational realities that apply to any deployment, CE included, regardless of license.

NTPSense Pro is commercial software. Sections 1 through 9 below constitute the EULA that governs Pro (and any paid hardware/support purchase) specifically — Pro's source is not published under Apache 2.0.

1. License grant (NTPSense Pro / commercial purchases)

Subject to your compliance with this License and payment of applicable fees (if any), NTPRO TEKNOLOGI JAYA, a Perseroan Perorangan (Indonesian single-shareholder limited liability company registered under Ministry of Law Decree No. AHU-A114329.AH.01.30.Tahun 2026) grants you a non-exclusive, non-transferable license to install and use the Software on hardware you own or control, for your own internal network operations or, if you are a managed service provider, for your clients' networks under a separate agreement with them.

You may not: (a) resell or sublicense the Software as a standalone product without a separate written agreement with us; (b) remove or obscure NTPSense branding from the Software's administrative interface; (c) use the Software to build a directly competing commercial gateway product without our written consent.

This section applies to NTPSense Pro only. NTPSense CE is licensed separately under Apache 2.0 — see Section 0 above.

2. No warranty

The software is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the software will be uninterrupted, error-free, or fully secure against all forms of intrusion, malware, or attack.

No verbal or written information given by NTPRO TEKNOLOGI JAYA, its directors, employees, resellers, or agents creates a warranty beyond what is expressly stated in a separately signed commercial agreement.

3. Security disclaimer

NTPSense InetGateway is designed to reduce network risk — it is not a guarantee against it. Specifically, and without limiting Section 2:

  • No firewall, proxy, or VPN product can guarantee protection against every current or future threat, misconfiguration, zero-day vulnerability, or social-engineering attack.
  • Security depends heavily on correct deployment, configuration, and ongoing maintenance by the operator — factors outside NTPSense's control once the Software leaves our hands.
  • We do not warrant that use of the Software will prevent unauthorized access, data breach, service disruption, or any specific security outcome.

4. Your responsibility as operator

As the person or organization deploying NTPSense InetGateway, you are responsible for:

  • Correct configuration of firewall rules, VPN, DHCP, and proxy settings for your environment.
  • Keeping the Software and underlying operating system updated with security patches we publish.
  • Physical and administrative security of the hardware running the Software.
  • Compliance with data protection law (e.g. Indonesia's UU PDP, or your own jurisdiction's equivalent) for any traffic or personal data that passes through your deployment — as noted in our Privacy Policy, you are the Data Controller for that traffic, not us.
  • Maintaining your own backups, incident response plan, and cyber-insurance coverage appropriate to your risk profile.

5. Limitation of liability

To the maximum extent permitted under the laws of the Republic of Indonesia:

  • NTPRO TEKNOLOGI JAYA, its directors, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, business interruption, or the cost of remediating a security incident — arising from or related to use of the Software, even if advised of the possibility of such damages.
  • Our total aggregate liability for any claim arising from the Software, however framed, will not exceed the amount you actually paid NTPRO TEKNOLOGI JAYA for the Software or hardware in the twelve (12) months preceding the claim — consistent with industry practice (e.g. Netgate/pfSense caps liability at purchase price paid, with no minimum floor). There is no minimum liability floor: for low-value transactions, the cap is simply the amount paid, however small — unless a separately signed commercial agreement states otherwise.
  • Nothing in this section excludes liability that cannot be lawfully excluded, including liability for willful misconduct or gross negligence directly attributable to NTPRO TEKNOLOGI JAYA.
  • Time limit to bring a claim: any claim arising from the Software must be brought within twelve (12) months of the date the incident giving rise to the claim occurred, or is permanently barred — regardless of the general limitation period that might otherwise apply under Indonesian law (KUHPerdata Article 1967).

6. Indemnification

You agree to indemnify and hold harmless NTPRO TEKNOLOGI JAYA, its directors, and its employees from any claim, loss, or damage (including reasonable legal fees) arising from: (a) your misuse or misconfiguration of the Software; (b) your violation of applicable law in how you deploy or operate the Software; (c) any content or traffic that passes through a network you operate using the Software; or (d) your breach of this License.

7. Open-source components

NTPSense InetGateway is built on FreeBSD and bundles third-party open-source software (Squid, Kea DHCP, WireGuard, Headscale/Tailscale, PHP, lighttpd, and others), each under its own upstream license. See our Open Source Notices page for the full list. To the extent any bundled component includes its own warranty disclaimer (most do — BSD, MIT, GPL, ISC, and Apache-2.0 licenses all disclaim warranty), that disclaimer applies independently of, and in addition to, this License.

8. Export & use restrictions

The Software includes cryptographic functionality (WireGuard-based VPN). You are responsible for complying with any export control, import, or use-of-cryptography law applicable in your country before deploying the Software internationally. NTPRO TEKNOLOGI JAYA makes no representation that the Software is authorized for import or use in every jurisdiction.

9. Termination

This License terminates automatically if you materially breach it and fail to cure within 30 days of notice. On termination, your right to use the Software ends, though hardware you own remains yours.

10. Governing law

This License is governed by the laws of the Republic of Indonesia, with exclusive jurisdiction in the courts of Jakarta, unless superseded by a separately signed commercial agreement.
